1. General Information

These Terms and Conditions govern the use of the website www.drakedivers.com and the contracting of services offered by Drake Divers Costa Rica, with registered address at Calle hacia los planes, Agujitas, Province of Puntarenas, 60503, Costa Rica (hereinafter, «Drake Divers» or «the company»).

Accessing and using this website implies full and unreserved acceptance of these terms. If you do not agree with them, please do not use this site.

These terms are governed by Law 7472 on the Promotion of Competition and Effective Consumer Protection, Law 8454 on Digital Certificates, Digital Signatures and Electronic Documents, and other applicable regulations in Costa Rica.

2. Description of Services

Drake Divers offers the following tourism and recreational services:

  • Recreational and adventure scuba diving at Caño Island.
  • PADI diving courses (Open Water, Advanced Open Water, Rescue Diver, Divemaster).
  • Snorkeling at Caño Island.
  • Tours to Corcovado National Park.
  • Wildlife watching tours.

3. Bookings and Payments

To make a booking, the client must complete the contact form or communicate directly with Drake Divers through the available channels. A booking is considered confirmed only once Drake Divers issues an express written confirmation (via email or WhatsApp).

Service prices are those communicated at the time of booking. Drake Divers reserves the right to modify its rates without prior notice, although any confirmed booking will be honored at the agreed price.

Entrance fees to Corcovado National Park and Caño Island are set by SINAC (National System of Conservation Areas) and may vary; these are the client’s responsibility and are not included in the service price unless expressly stated.

Payment can be made by bank deposit to the following account:

Note: Please include the payment receipt when sending your booking confirmation via email.

We recommend booking at least one month in advance for Corcovado National Park tours, due to the park’s limited daily visitor capacity.

4. Cancellation and Refund Policy

Entrance fees for Corcovado National Park and Caño Island are non-refundable under any circumstances, in accordance with the policies of SINAC and the managing authorities of both protected areas. These fees are:

  • Corcovado National Park: $30 per person
  • Caño Island: $20 per person

Cancellation terms for the remaining service amount are as follows:

  • Cancellations made more than 15 days in advance: only the Corcovado National Park entrance fee will be charged, where applicable. The rest of the amount will be fully refunded.
  • Cancellations made more than 48 hours in advance: a 50% penalty of the total reservation applies, plus Corcovado National Park entrance fees where applicable.
  • Cancellations made less than 48 hours in advance: full penalty applies — no refund will be issued.

Drake Divers reserves the right to cancel or reschedule activities due to adverse weather conditions, decisions by maritime or park authorities, or force majeure events, in which case the client will be entitled to reschedule at no additional cost or receive a full refund, excluding non-refundable entrance fees.

5. Children Policy and Participation Requirements

Minimum age requirements:

  • Snorkeling at Caño Island: from 5 years old. Children between 5 and 10 years old must be under the constant supervision and care of a parent or responsible adult.
  • Scuba diving (Discover Scuba Diving and Open Water Course): from 10 years old, in accordance with PADI standards.
  • Corcovado National Park tours with children under 4 years old require the hiring of a private guide.

Children’s rates (applicable to children from 2 to 9 years old; children under 2 years old do not pay the tour fee):

Participants must be in good health. Certain medical conditions may prevent participation in diving activities. Drake Divers may request a health declaration or medical certificate when deemed necessary. The client agrees to participate in activities at their own risk, following the instructions of Drake Divers staff at all times.

Drake Divers is not liable for damage or loss caused by the client’s failure to follow safety instructions, force majeure events, or circumstances beyond the company’s control.

6. Intellectual Property

All website content (texts, images, logos, videos, graphic design) is the property of Drake Divers or its licensors and is protected by applicable intellectual property laws. Reproduction, distribution, or use without the express written authorization of Drake Divers is strictly prohibited.

7. Limitation of Liability

Drake Divers does not guarantee the continuous and uninterrupted availability of the website and is not responsible for damages arising from technical interruptions, errors, or unauthorized access to the site, to the extent permitted by Costa Rican law.

8. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Costa Rica. For the resolution of any dispute arising from the use of this website or the contracting of services, the parties submit to the competent courts of Costa Rica, expressly waiving any other jurisdiction that may apply to them.
